We decided in the CWC at NGP held on 30th and 31st Aug 2015 to stage an indefinite fast before the Railway Board in the month of December 2015 on demands of the implementation High Power Committee recommendations on duty hours, rest, night duty, periodical rest, with modification suggested by AILRSA along-with implementation of minutes of Railway Officers’ meeting on SPAD, review the measure of punishment on SPAD and implementation of High Level Safety Review Committee.

You are aware that the intensive classification of loco running staff declared by the RLC, Madurai and upheld by the Secretary, Ministry of Labour (Appellate Authority) has been challenged by the Railway in High court of Chennai and other issues like Grade Pay, Running allowance, Onerous duty allowance to all, etc pending before the National Industrial Tribunal, Mumbai. The PR of 46 hours as ordered by the RLC/SBC has been approved by the High court of Bangalore but still the Railway Board has not issued any order for implementation. A contempt petition was filed in High court. We are pursuing all these processes vigorously and we expect a favourable outcome too.

We are expecting the submission of 7th CPC before January 2016. Whether our submission before the 7th CPC has been conceded or not is to be known only after the publishing of 7th CPC report.

At this stage therefore we confined our demand, that the Ministry of Railway should accept / implement the recommendations of the HPC 2013, with due consideration of the modifications as suggested by us along-with some other vital demands. In order to press our demand the CWC decided to submit a petition to the Petition Committee, Lok Sabha and simultaneously hold a 36 hours fast before the Railway Board commencing on 14th December 2015, modifying the decision of indefinite fast.

It is our decision that the programme should be a massive one, with a participation of at least 3000 running staff and their families. To see that the target to be achieved, and for the successful program, every office bearer of Central, Zone, Division and Branch have to meet the workers and enlighten them the necessity for massive showdown before the Railway Board.

To reach the message with due consultation with other leading comrades, I, as the Secretary General, direct you to implement the following programme meticulously in your area and a detailed report on your efforts including expected participation in the Fast before the Rail Bhawan be submitted to the central committee by 30th November 2015.

1) The Programme and the demand be reached to every workers through the Whatsapp, Face book, etc liberally utilize the social media, to see that the message reaches to every worker not later than 1st November and repeat the process every 15 days till 14th December.

2) Main wall poster will be supplied by the Central Committee not later than 1st November. Flex boards/ banners should be installed in every crew lobby and in prominent places in your area immediately, matter should be confined to our demand on HPC minutes of Railway Officers’ meeting on SPAD and review the punishment measure on SPAD. Matter for leaflets will be supplied by Central and be printed by the concerned zonal committees.

3) A divisional demonstration in front of the DRM office be held on 2nd November 2015, with massive participation, small posters and leaflets should be prepared, printed and distributed by the Divisional committee. A memorandum also to be submitted to the Minister for Railways, through the DRM with an advance copy to MR by speed post. Matter for memorandum will be supplied by the Central Committee.

4) Demonstration / Gate meeting should be organized on 20th November 2015 in front of every crew lobby, to explain the demand and the program to the workers. Decorate the crew lobby with Flex banners, etc as you think appropriate.

5) Individual letter to Minister for Railways be sent between 20th November and 30th November. The matter to be printed in Inland letter. Matter will be supplied by the Central Committee.

6) In addition to these, the Central Committee will also send memorandum to PM, MR, Labour Minister and CRB by October 2015.

7) Central Committee memorandum to be submitted to the Local Member of Parliament irrespective of political affiliations by the respective divisions with a request letter to forward it to MR between 20th November and 30th Novenber.

8) On 8th, 9th and 10th December 2015 our Secretary General along with Com. K.A.S.Mani, Com.K.C.James, Com.P.N.Soman and M.P.Deo, Jit Singh Tank, R. R. Bhagat (selected comrades from other Railways to be nominated by the Secretary General) will go to NDLS to meet Hon’ble Speaker, Loksabha and various MPs.

9) In the meantime the Central Committee will submit the petition to the Petition Committee, Lok Sabha.

All are requested to actively pursue these programs and see that a massive participation in 14th December Fast at New Delhi.

MATTER FOR INDIVIDUAL LETTER CAMPAIGN

Respected sir,

I belong to the Loco Running staff category of the Indian Railways. In 2006 the Railway Board agreed to constitute a High Power Committee with an eminent Judge of High Court, to go into the issue of Duty hours, rest, periodical rest, continuous night duty and allied matters pertaining to loco running staff. Though such an agreement was entered with the staff side, constitution of High Power Committee never took place for a long period of 5 years, till 2011.

The said committee deliberated the issue of Duty Hours, Rest, Periodical rest, Night duty and allied matters with all stake holders ie the Railway Management, Unions, Federations etc. The committee submitted its recommendations in Aug 2013.

The staff side also discussed the recommendations with the Ministry of Railways and requested some modifications in one or two recommendations though most of the recommendations were accepted by the staff side. Even after a lapse of 2 years, the recommendations gather dust and no serious efforts seem to be taken to implement the same.

Continuous duty for 13hrs. and above in one trip, crippling effect of continuous night duty for 6 nights, inadequate rest after every trip, meager weekly rest, appalling condition of the Running rooms, stringent punishment of Removal/Dismissal for Signal Passing At Danger which caused no repercussion , made the life of running staff miserable. The cascading effect of such service condition reverberate in their family and social life and even they are not in a position to look after children and aged parents as other railway workers do.

Taking all these infirmities and to find a solution on this issue of running staff, the Railway Board with a social outlook and as a model employer earnestly constituted this committee. The staff also waited for 10 long years silently suffering all the odds attached to their peculiar working conditions in the hope that the precarious condition of work will be eased by the Railway Board with its earnest by accepting and implementing the recommendations atleast in a short time frame. Still we keep our hope that justice will be extended in a war footing.

Sir, I as a subordinate, plead before your Ministry to accept and implement the recommendations of High Power Committee 2013 along-with minutes of officers meeting on SPAD, HLSRC recommendation and also consider the grievances is submitted by AILRSA on 4th May 2015 for a better life for me, my colleagues and the family.

RESOLUTIONS:-

The Central Working Committee of AILRSA met at MaheswariBhavan, Nagpur on 30th and 31st August under the presidium consisting of Com.L.Mony, President, Com. N.B.Datta, Working President and Com.K.A.S. Mani, Vice President. About 71 Com. Have attended the meeting amongst which 47 Com. Have spoken on agenda.

After thread-bared discussion the meeting adopted the following resolutions.

1. This meeting finds that the demands of the strike called by the central trade unions on 2nd September 2015, such as, protection of PSUs,enhancement of bonus ceiling, fixing of minimum wages at rupees 15,000/- per month and maintenance of labour laws etc. are genuine and aimed at betterment of working class including Railwaymen. So we call upon all the members of AILRSA to support the strike with solidarity actions including demo leaflets, gate meetings, postering etc. and propagate the demands among the public.

2. The Central Working Committee meeting of AILRSA whole heartedly welcome the decision of AIRF and NFIR to struck work indefinitely, jointly with other Central Government employees from 23rd November 2015 on the joint demands of Central Government employees. We appreciate the leadership of AIRF and NFIR for taking the correct course of workers’ agitation depending on the might of the working class, which alone will compel the Government to come out of the grip of Capitalist forces and to do justice to the working class. We call upon all democratic forces to strive hard for the success of the proposed strike.

3. We also appeal to the JCM organisations to build up absolute unity among Central Government employees by way of collective propaganda and preparation for strike incorporating all registered/non-JCM trade unions, which alone create confidence among the railway workers. We also suggest to build up cooperation and support groups among all the democratic forces who can give outside support for the causes of the Government employees. This Association assures wholehearted participation in the proposed strike and its preparations which accommodates all forces who support it.

4. The Central Working Committee vehemently protests against the arbitrary and unlawful reduction in the status of Sr Loco Pilot/Shg and Sr.Assistant Loco Pilot for fixing the eligibility criteria for Group B selection vide RBE No. 92/2015. As Sr.Loco Pilot/Shg in GP Rs.4200 and Sr.ALP with GP Rs.2400 are equated with non-running GP of Rs.4600 and Rs.4200 respectively vide RBE 53/2011 considering the weightage of their pay element. The unilateral reduction in GP from 4600 to 4200 for Sr. Loco Pilot/Shg and from 4200 to 2400 for Sr.ALP even in specific case of Gr. ‘B’ Selection in the equivalent non-running pay scales is without any reason, while strongly protesting against this discrimination of two categories in loco running cadres this meeting request to revise.


5. This CWC Meeting expresses its protest against the apathy shown by the railway management in implementing the recommendations of various committees appointed by the Railway Board itself to improve safety in railways, despite numerous agitations demanding the same by loco running staff making the whole exercise a mockery. We reiterate the demand to implement the Minutes of the SPAD meeting, recommendations of HPC on HOER, with modification as suggested by AILRSA, HLSRC and Khanna Committee without any further delay.


6. AILRSA demands to reject the recommendations of Bibek Debroy Committee totally although presently it is kept in abeyance. The recommendations of Bibek Debroy Committee as the thrust of the entire recommendation is to convert the railway business to a commercial one and allowing the private operators to loot the people. In fine, it is intended to privatize the profits and nationalize the losses.

7. This House vehemently opposes the FDI in railways as it will cause inordinate increase in rail tariff which is against the interest of the general public and detrimental to the Indian economy.

8. The present system of selection of Chief Loco Inspector through general selection process is to be scrapped as it paves way for selecting employees who have negligible experience in running trains. Which badly effects the efficiency on loco pilot working some of the CLIs who have very less driving experience when compared to that of loco pilots whom the CLIs are supposed to counsel or monitor. As it is creating various problems in working, in addition to that, lack of experience prevents them to understand various critical problems faced by the loco pilots and leads to wrong reports being sent to officers resulting in harassment and penal action for no fault of the loco running staff. Such incidents lead to sabotage the industrial harmony in many areas. So we demand to restore back to the old system of selecting CLIs through seniority-cum-suitability.

9. Gradation of employees in safety category has serious effect in assigning duty as well as in promotion. Now the proposals from the reporting supervisor are being accepted by the controlling officer. This meeting urges the railway administration to give an opportunity to the concerned employee to explain his part in case of an adverse remark before accepting the same by the controlling officer as ‘audialterampartem’ is the rule of the Principle of Natural Justice.

10. SWR administration had started a crew booking depot at Chickjajur in between Arsikare and Harihar, duly reducing the staff strength at neighbouring depots. Now about 100 running staff are posted there. Chickjajur is a way-side station without even the minimum facilities for education and medical attention. Only four quarters are provided for loco running staff. All are staying in an old building and are commuting from either Harihar or Arsikare, where their families are settled.

Further, the crew beat towards Bangalore is 280KM and towards Hubli 187KM. This union had collected the opinion of entire staff of Mysore Division and they unanimously suggested to centralize the crew operation at Birur Junction where educational and medical facilities are far better. The distance between Birur and Hubli is 257KM and Birur and Bangalore is 210KM. Similarly, the

Castle Rock depot of UBL Division is to be wound up and staff re-located to Vasco for want of better facilities.

11. In NGP division of C.Railway Shri M.P.Deo, Loco Pilot (M&E), is having 27 years of accident free meritorious service with 9 awards in service. But for seeking information under RTI Act in the interest of railway safety he was intentionally, revengefully and prejudicially targeted by Sr.DEE/TRO. and framed him with the help of his nominated CLI. Sr.DEE(TRO) & DEE(TRO) by fabricating charges with manipulating the documents to down-grade him from ‘A’ safety category to ‘D’ in just 26 days and penalized with vague and false charges and kept him without allotting any duty resulting in ‘no work, no pay’. Officers’ fact finding committee had been constituted to find out the case for it and the committee ruled out his degradation from safety category and proved the unlawful, uncalled for, still the administration has not restored his status and not allowed him to perform his duty. This attitude of Sr.DEE/TRO/NGP/CR had created unrest amongst the loco running staff and hence this meeting while protesting this unlawful , biased action against Sri M.P.Deo demands DRM/NGP/CR to find an end for the growing disharmony between the loco running staff and their controlling officers which is detrimental to train services as well as safety.

12. The Railway Board have revised the subsidy amount per meals for running staff at running rooms to Rs.41 vide Lr. No.2006/M(L)/467/2 dated 12-08-2015 with further instructions to zonal railways to revise the amount of subsidized meal every 6 months taking into account CPI(W) of June and December. We appreciate the revision and demand all DRMs to make necessary changes in the contracts now in operation and also to effect necessary changes in future tenders.

ORGANISATIONAL RESOLUTIONS

I. Organise an indefinite fast by all the CWC members before Rail Bhavan during winter session of Parliament to persuade the Ministry of Railways to accept the recommendations of HPC on HOER with modification as suggested and implement the minutes of the meeting on SPAD HLSRC and Khanna committee recommendation.

(i) At least 5000 loco running staff and family members to be mobilized to Delhi to support the fast.

(ii) A petition to be submitted before the Petitions Committee of Lok Sabha to intervene in the matter.

(iii) All MPs of Lok Sabha shall be approached by local staff to garner their support to our cause.

(iv) A tour programme of central office bearers to be planned to mobilise the staff to Delhi.

(v) Massive postering and releasing of leaflets to be planned by central committee.

(vi) The representations will be prepared by Com. L.Mony and Southern Railway will make arrangements to send the letters by post to all MPs.

(vii) A team of office bearers from various zones shall camp at Delhi for a week prior to the hunger fast to meet important MPs and leaders to seek their support for our cause and achieving a positive result.

II. With a view to strengthen the working of zonal committees, in co-operation with the concerned General Secretary, the following comrades are nominated:

(i) CR, NWR, WCR, WR & NCR – Com.M.P.Deo&A.K.Singh.

(ii) SER, ECoR, ER – Com. Chandan Sarkar, Paras Kumar &N.B.Dutta.

(iii) NFR, ECR & NE – RamrajBhagat.

(iv) SR, SWR & SCR – L.Mony, K.A.S.Mani, K.C.James&C.Sunish. 

(v) NR – Ramsharan&Paramjeet Singh.

This team will also have the tour program in respective zone the date may be fixed conveniently with consultation of GS of respective zones.

III. The following action programme is taken to support the agitation of NGP comrades against the vindictive attitude of Sr.DEE/TRO/NGP/CR.

(i) A struggle fund of Re.1 in each month to be collected from all loco running staff of Indian Railways. Receipt to be printed by zone.

(ii) A write up on the issue at NGP to be prepared by CR, to explain the matter to each and every loco man.

(iii) All branches shall take a three day campaign on the issue, deputing some comrades round the clock at lobby for explaining the issue, collecting signatures in a mass memorandum and collecting the token struggle fund.
